Italian trademark penalties

Italian law n. 99/09 of 23rd July 2009, (OJ n. 176 of 31st July 2009) "Measure enhancing and internationalizing business, as well as on energy" amending articles 473, 474 and 517 of Italian criminal law provides further prohibitive penalties over Italian trademark’s abuse.

Rules now in force provide the following sanctions:

By 4 years in jail as well as Euro 35.000,00 of penalty introducing counterfeited goods in Italy

By 3 years in jail as well as Euro 25.000,00 of penalty using or counterfeiting goods

By 2 years in jail as well as Euro 20.000,00 of penalty keeping or storaging as well as counterfeiting goods
